How to Negotiate CAM Fees in Commercial LeasesHow to Negotiate CAM Fees in Commercial LeasesThe larger the commercial space you rent, the more likely you will be able to negotiate CAM (Common Area Maintenance) fees and any associated administrative fees. However, no matter how small the space, never accept the terms of any lease without asking for a better deal. In a cautionary statement about the difficulty of breaking into the commercial real estate industry, CFO Magazine reporter, Laura DeMars, clearly indicates that even real estate professionals may have a hard time understanding the complexities of CAM fees The complexity of the industry makes it tough to break into DeMars further states At shopping centers, for instance, tenants usually pay for the upkeep of the building through a common-area maintenance (CAM) fee. While a CFO of a property-management firm doesnt directly manage the tenants, he still needs to understand how those fees are collected more important, since large retailers often dispute CAM fees or pay only a percentage the CFO must know how to account for the difference, or CAM slippage. Before you attempt to negotiate CAM or Administrative Fees, be sure that you understand what they are. If CAM fees are a complicated issue for CFOs, you better go in prepared Industry Standard CAM Fees Because the condition of certain common areas has a direct effect on tenants, fees associated with the costs of maintenance and repair of hallways, elevators, stairwells, lobbies, and common area restrooms are fairly voreingestellt in CAM fees. Also typically assessed to tenants in CAM fees are costs associated with parking lot maintenance (including lighting and landscaping), and sidewalks. Tips on Negotiating Standard CAM Fees If the type of fees you are being asked to pay are non-negotiable, make sure your lease specifically permits you to review the landlords bills. Business is business, and this should not be seen as a distrust of a landlord or something personal, but paying unknown fees simply in good faith is not good business.Requiring a statement in the least that the landlord has to provide documentation (accountability) for all fees charged is the only way to ensure you are being charged fairly. You should also negotiate how much CAM fees can increase each year putting a maximum amount or percentage. This cap should be listed separately from any other rent increases. Operations and Management (OM) Administrative Fees If your lease requires you to pay CAM fees for any operational or management costs immediately object to such costs. If the landlord insists, ask to see a list (proof) of these costs and how your share has been calculated. ansicht fees may not actually be called CAM fees, but Administrative Fees. Administrative fees are still CAM fees the landlord is trying to get you to contribute to his/her own costs. Administrative fees are usually based on a percent of the total CAM costs. Tips on Negotiat ing OM Administrative Fees Most tenants will object to operational and management fees because the landlord is already making income off the rent being charged even without CAM fees. If your CAM fee includes salaries for management or administrative staff (on- or off-site), liability insurance costs (you will have to pay for your own liability insurance the landlord will require this before you can move in), advertising and other promotional activities, professional services such as legal or accounting services, try to negotiate these out of your lease. According to Rosie Rees, The Battle Over CAM Charges,Retail Traffic Magazine Savvy tenants will reduce the percentage (which ranges from 25% to 5%), and exclude non-maintenance-type costs from the calculation (e.g., taxes, insurance, utilities). Rees also believes that maintenance and repair costs related to the buildings (i.e., roofs, building foundations, and exterior walls) should not be absorbed by tenants as these are not comm on areas used by the tenants or their customers. Rees accurately points out The landlord already gets income from those buildings in the form of rent. Any costs of maintaining and replacing them should be paid by the landlord out of rental income. Naturally, then, he decided to occupy himself by pulling pranks on his colleagues.Knowing that fruchtwein of them were relatively careless when dealing with the safes that stored top secret documents - whether forgetting to lock them, or leaving them on factory settings, or choosing obvious dates as their codes - he began leaving leides in the place of their work likeI borrowed document no. LA4312 - Feynman the safecracker.Eventually, he got so good at it that the Colonel in charge of his unit began advising people that if Feynman had been anywhere near their s afe, it was a part of their job to change their combination lock once mora.This story is one of many stories Feynman tells in his autobiography Surely, Youre Joking Mr. Feynman, where his playful nature gets the better out of both him and his attention.One of the things Ive personally always admired about Feynman is that he was so deeply curious about things that the only purpose behind what he decided to commit himself to was what he found interesting.He had general aims, Im sure, and given the complexity of the work he put out, he was obviously an insanely focused person, but the orienting impulse that guided him was beyond goals and simple ambitions. He was far more interested in getting somewhere past the known.Goals as orientation are common in almost all of our pursuits. We look ahead, predict what may make us happy in the future, and we then narrow down towards something specific. But what if thats not the way?Is living goal to goal the answer?When dealing with the future, an orientation of some sort - however vague or specific - is necessary. If we didnt have one, we would be entirely shaped by the current of luck and randomness, which isnt always a blessing.To exercise some semblance of agency over our lives, then, we often resort to goal-setting. We are taught to do so early on so that we can keep up with the world around us. Later, corporations, for example, even have acronyms, like SMART goals, that have us continuing to do so.Now, whether we are setting SMART goals or personal ones under our own framework (or no framework), the one thing that they have in common is that they are relatively concrete. You want to be married by 30, earn an executive position by 40, and be retired by 50. Thats how they usually go.For the most part, my inclination is to say that having unterstellung is better than not having any, and certain people have a genetic disposition to find satisfaction in specific accomplishment more so than others, but there are also probl ems that come with spending an entire life living goal to goal.For one, it attempts to predict an unpredictable future. Who is to say that what you want tomorrow or the year after is the same thing you want right now? More critically, what if what you want right now isnt even oriented in the right direction over the long-term and youre actually going the wrong way? Life changes, we change, and none of this is evident without hindsight.Secondly, and just as importantly, it creates an anchor You bind your expectations of happiness and contentment onto something so singular that you often forget that other things in your life are capable of adding just as much joy to your experience than the thing youre so fixated on.Everybody knows that the ultimate reward is the process, not the goal, but what we forget is that the virtue of even having goals makes it very hard to stay honest to a process that often deviates day to day.This creates a strange tension On one end, goals of some sort are necessary, and giving the future its due attention is the right thing to do on the other hand, the act of creating these goals and worshiping them, as we often do, leads to a conflict that we cant easily get away from.To solve this tension, we have to move towards something more nebulous.The pursuit of interestingnessThe really fascinating, and even admirable, thing about Feynman was that if he ever had a goal, it was simply this to learn as much as possible in any direction that his innate curiosity took him.For brief periods of his time, working on one problem or the other, he may have had more specific goals, sure, and he certainly took the time to focus on them as he needed without distractions. But broadly, his orientation was pointed towards the most interesting thing he could find.The pursuit of interestingness, I think, solves the predicament that is inherent in goal-setting. Its vague and nebulous enough to be honest about the unpredictability of the future, without being hopelessly lost in the chaos of pure luck and randomness.Throughout life, we all see things, learn things, and pursue things. This process is different for each of us, but as we do so, we also develop a very strong intuition of what we, personally, find fascinating about the world - something that aligns with our deeper nature while respecting that we change over time as menschengerecht beings, letting us adapt accordingly.Interestingness isnt hedonism or materialism or the chase of anything new and shiny that seeks to distract us. Its deeper than that. Its taking on that random project you had no plan to take on because you have a feeling that you might just learn something you didnt know about yourself. Its seeing a person you just met not as a potential partner or someone who can do something for you but simply as an individual who may open up a new, unknown, and unique dimension in your life.The great thing about pursuing this kind of interestingness is that it has a far shorte r feedback loop than specific goals. You keep doing something for as long as its interesting, but if you were mistaken about your initial impulse, you move on, without too much lost.Naturally, not everything or everyone is interesting all the time, but generally speaking, if something maintains its interest over a period of time, its likely worth dedicating some energy to.By making interestingness the goal, you give your actual goals a fluidity, one that can better accommodate new information. This also better amalgamates the goal with the process, rather than the goal being a distinct thing that battles to keep your attention off of the process.More than anything, however, the pursuit of interestingness honors a simple truth about the human experience The best things in life are by-products. They come when they come, as you commit yourself honestly to a process, not when you spend time striving for imagined perfection.The takeawayThe future demands attention, and while focusing all of our energy on it is self-defeating, we do need to be intentional about directing some of our effort towards it as we orient ourselves in the world.Goals are one way to do that. They give us a way to make concrete what is otherwise uncertain so that we can make progress without losing ourselves to anxiety. The problem, however, is that they often mistake what exists to provide orientation as a thing of value in itself.The best way out of this trap is to pursue what is interesting - to use our intuition for what it is that we find novel in this world to make the process and the goal one and the same thing to continually update our sense of what is worth pursuing without being confined to false certainty.Interestingness seeks out the riddle of life. It gives us a reason to turn the next page, to see the next scene, to give form to the unknown.Feynman embodied this, but he also once said something that captures what it is that differentiates such a pursuit from mere goals and certa intiesI think it is much more interesting to live not knowing than to have answers that might be wrong. If we will only allow that, as we progress, we remain unsure, we will leave opportunities for alternatives In order to make progress, one must leave the door to the unknown ajar.Goals, incorrectly, assume that we already know what it is that we want. Interestingness is more humble. It makes up its mind as it moves, slowly blowing from one thing to another, until it eventually grasps something that lies beyond prediction.Looking ahead, imagining scenarios that we think may be worth our time, has a place, but at the end of the day, what is most relevant is unfolding around us right now, and it doesnt care what we thought about it yesterday.Want to think and live smarter? Especially for the sight impaired it is quite disturbing to see an alarming trend in the number of website pages that open and display text that is too small for the human eye to read, even with the aid of glasses. And this doesnt apply to that age-old dreaded fine print you see in disclaimers, terms, and privacy policies. You have come to expect that, especially from businesses that dont want you to know that theres a 20% re-stocking fee should you decide to return those shoes that looked better online. The bigger problem is the actual content, and even sidebar links displayed on websites that you either want to read or need to read. You Cant Fight City nachhall Even some government agencies (including the IRS) have begun to incorporate tiny, unreadable text into their websites. You may find this particularly curious because it is these very federal and state governments that regulate and enforce the Americans with Disabilities Act and advocate for accessibility. But, as the saying goes You cant fight City Hall. Instead of fighting City Hall its best to take matters into your own hands. Unless you are severely vision impaired it is quite easy to enlarge (or reduce) text to make it more readable on your computer screen. The best part is you dont have to spend the time or money to purchase or download special software. Microsoft Internet Explorer (All Versions) If you encounter a website with small text using Internet Explorer use the drop-down menu in your taskbar to select the following options to increase or decrease the fonts appearance View Text Size Largest, Larger, Medium, Smaller, Smallest Mozilla Firefox and Netscape 6.2, 7.0 and 8.1 The following steps will help you enlarge or reduce the appearance of text on a web page viewed in Firefox or Netscape. Begin by opening the browser window to the page you want to either view in larger textor make the text smaller. To Enlarge Text Press and hold down the control (Ctrl) key on your keyboard and then press the plus () key. Repeat Ctrl untilthe text reaches the fruchtwein comfortable size for you.To Reduce Text Size Press and hold down the control (Ctrl) key on your keyboard and then press the minus (-) key. Repeat Ctrl - until the text is the desired size tofit yourviewing screen. Apple Safari (All Versions) Use the following steps to enlarge or reduce the appearance of text on a web page in Apple Safari. Begin by opening the browser window to the page you want to either view in larger text or make the text smaller. To Enlarge Text Press and hold down the Apple key on your keyboard and then press the plus () key. Keep repeating this process until you can easily and comfortably read all of the text.To Reduce Text Size Press and hold down the Apple key on your keyboard and then press the minus (-) key. Keep repeating this process until the text is the most viewing size for you and fits within your monitor screen. There is only caveat to fixing this annoying and often troublesome computer situation. You will not be able to do these steps on a mobile device because of the lack of the control tab. However, given the speed at which technology is advancing, it wont be long before this IT issue is resolved.
